These Terms and Conditions (“Terms”) govern your access to and use of The Sundry website, currently available at goodsundry.com and related domains (the “Site”), including any products, content, maker listings, links, memberships, features, and services offered through the Site.

By accessing or using the Site, you agree to these Terms. If you do not agree with these Terms, please do not use the Site.

1. ABOUT THE SUNDRY

The Sundry is an online market and local discovery platform created to make it easier for people to find, support, and shop from small businesses and independent makers.

The Site may include:

• Products sold directly by The Sundry;

• Listings and profiles for independent makers and businesses;

• Product information and links directing visitors to third-party maker websites, stores, social media accounts, or other purchasing methods;

• Select products from independent makers that may be available for purchase directly through The Sundry; and

• Other content, resources, events, promotions, or services related to The Sundry community.

Different goods. Different makers. One place to find them.

2. INDEPENDENT MAKERS

Businesses featured through The Sundry (“Makers”) are independently owned and operated businesses unless expressly stated otherwise.

A Maker's inclusion on the Site does not create an employment, agency, partnership, joint venture, franchise, or other similar relationship between the Maker and The Sundry.

Makers remain responsible for their own businesses, including their products, pricing, product claims, availability, licenses and permits, taxes, fulfillment, shipping, customer service, returns, warranties, and compliance with applicable laws.

3. THIRD-PARTY PRODUCTS & LINKS

Many products displayed on The Sundry are included for discovery purposes.

When a product includes a link such as “Shop This Maker,” “Shop This Product,” “Visit Their Website,” or similar language, clicking that link may take you to a website, online store, social media account, or other platform operated by an independent Maker.

Unless otherwise stated, The Sundry is not the seller in those transactions.

Your purchase is made directly from the Maker and is subject to that Maker's prices, payment terms, shipping policies, return policies, privacy practices, and other applicable terms.

The Sundry does not control third-party websites and cannot guarantee their availability, accuracy, security, products, services, or policies.

4. PRODUCTS SOLD BY THE SUNDRY

Certain products may be sold directly by The Sundry.

Products sold directly by The Sundry will be identified through the applicable product page and checkout process.

We make reasonable efforts to display product descriptions, photographs, pricing, availability, colors, dimensions, and other information accurately. However, handmade, small-batch, natural, vintage, or artisan goods may have reasonable variations from photographs or descriptions.

We reserve the right to correct errors, update information, change pricing, limit quantities, or discontinue products at any time.

5. PRODUCTS FROM SUNDRY MAKERS SOLD THROUGH THE SITE

From time to time, select products from participating Makers may be available for purchase directly through The Sundry rather than through an external link.

When applicable, the product page or checkout experience may identify the Maker associated with the product.

Fulfillment, shipping, availability, returns, and other conditions for these products may vary depending on the Maker and will be governed by the policies communicated with the applicable product or order.

6. ORDERS & PAYMENT

For purchases made directly through The Sundry, you agree to provide current, complete, and accurate billing, shipping, and payment information.

We reserve the right to refuse, limit, or cancel an order where reasonably necessary, including in cases involving suspected fraud, incorrect pricing, product unavailability, or other order-processing issues.

Applicable taxes, shipping charges, and other fees will be displayed when required.

For transactions processed through Squarespace, Squarespace states that the site operator remains responsible for its ecommerce transactions, including fulfillment, customer service, refunds, product claims, and applicable legal requirements.

7. SHIPPING, PICKUP & DELIVERY

Shipping, local pickup, or delivery options may vary by product.

For products sold directly by The Sundry, available fulfillment options and applicable charges will be provided during checkout.

For purchases completed directly with an independent Maker outside The Sundry, the Maker's own shipping, pickup, and delivery policies apply.

Estimated fulfillment or delivery dates are estimates unless expressly guaranteed.

8. RETURNS & REFUNDS

Products purchased directly from The Sundry are subject to The Sundry's posted Return & Refund Policy.

Products purchased directly from an independent Maker through the Maker's own website, store, social media, or other sales channel are subject to that Maker's return and refund policies.

Questions regarding a purchase made directly from a Maker should be directed to that Maker.

9. MAKER INFORMATION

The Sundry works with Makers to provide useful and accurate information about their businesses and products.

However, information including product availability, prices, ingredients, materials, business hours, market schedules, shipping availability, and external links may change.

Makers are responsible for providing accurate information and notifying The Sundry of material changes to their listings.

We reserve the right to edit, update, suspend, decline, or remove Maker listings or products when necessary to maintain the quality, accuracy, safety, and integrity of The Sundry.

10. THE SUNDRY MAKER MEMBERSHIP

The Sundry may offer paid memberships to eligible Makers that provide listing, discovery, profile, product-feature, or other benefits.

Maker Memberships are governed by additional Maker Membership Terms or a Maker Agreement presented during enrollment.

Those terms may address membership fees, recurring billing, cancellation, listing requirements, content permissions, eligibility, marketing use, and other conditions specific to participation as a Sundry Maker.

If there is a conflict between these general Website Terms and an applicable Maker Agreement concerning a Maker's participation in The Sundry, the Maker Agreement will control with respect to that participation.

11. THE SUNDRY MARKETING

Maker businesses, products, stories, photographs, logos, and other approved materials may appear throughout The Sundry's website, social media, email marketing, collections, gift guides, features, and other promotional content when permission has been granted by the applicable Maker.

Participation in The Sundry does not guarantee any particular amount, frequency, placement, reach, engagement, sales, or marketing exposure.

The Sundry determines its editorial and promotional content at its discretion.

12. NO GUARANTEE OF SALES OR RESULTS

The Sundry's purpose is to help customers discover small businesses and provide Makers with another avenue for visibility and growth.

However, The Sundry does not guarantee sales, website traffic, followers, leads, customer inquiries, social-media engagement, revenue, or other business results for any participating Maker.

Likewise, inclusion of a Maker or product on The Sundry should not be interpreted as a guarantee or warranty regarding that business or product.

13. INTELLECTUAL PROPERTY

Unless otherwise indicated, The Sundry's name, branding, website design, original written content, graphics, illustrations, photographs, logos, and other original materials are owned by or licensed to The Sundry and are protected by applicable intellectual-property laws.

You may use the Site for personal, non-commercial purposes.

You may not copy, reproduce, distribute, modify, sell, commercially exploit, or create derivative works from The Sundry's protected content without permission.

Maker names, trademarks, logos, photographs, products, and other materials remain the property of their respective owners where applicable.

14. ACCEPTABLE USE

You agree not to use the Site to engage in unlawful, fraudulent, abusive, harmful, or deceptive conduct; interfere with the operation or security of the Site; attempt unauthorized access to the Site or associated systems; scrape or systematically extract Site content for commercial use; impersonate another person or business; or infringe upon the intellectual-property, privacy, or other rights of another party.

15. PRODUCT & BUSINESS DISCLAIMER

The Sundry strives to curate businesses that align with our values of quality, creativity, and community.

However, featuring a Maker does not constitute a professional certification, warranty, or guarantee by The Sundry regarding every product, representation, service, or action of that Maker.

Customers should review applicable product information and contact the Maker directly with questions regarding ingredients, allergens, materials, product use, custom orders, or other Maker-specific concerns.

16. PRIVACY

Your use of the Site is also subject to The Sundry's Privacy Policy, which explains how personal information may be collected, used, stored, and shared.

Squarespace recommends that sites maintain a privacy policy explaining their data practices and, where applicable, address cookies and consent.

17. EMAIL & MARKETING COMMUNICATIONS

If you voluntarily subscribe to The Sundry's emails or other marketing communications, you may receive information about new Makers, products, events, promotions, market updates, and other Sundry news.

You may unsubscribe from marketing emails using the unsubscribe link provided in those communications.

18. WEBSITE AVAILABILITY

We may modify, update, suspend, discontinue, or restrict any portion of the Site at any time.

We do not guarantee that the Site will always be available, uninterrupted, secure, or error-free.

19. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Site and its content are provided on an “as is” and “as available” basis.

Except for warranties that cannot legally be excluded, The Sundry makes no express or implied warranties regarding the operation of the Site, third-party businesses, third-party websites, or information provided through the Site.

20. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, The Sundry and its owners, officers, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or your dealings with independent Makers or third-party websites.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

21. GOVERNING LAW

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any disputes arising under these Terms will be handled in accordance with applicable law and any additional dispute-resolution provisions agreed to by the parties.

22. CHANGES TO THESE TERMS

We may update these Terms periodically as The Sundry grows, our services change, or legal and operational requirements evolve.

When changes are made, the “Last Updated” date at the top of this page will be revised.

Your continued use of the Site after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.
